Aditya Pancholi gets relief in 2005 assault case

As per a Hindustan Times report, a sessions court in Mumbai has upheld the conviction of actor Aditya Pancholi in a 2005 parking assault case. However, they have modified the original one-year jail term handed down by a magistrate. Instead of serving time, Pancholi has now been ordered to be released on a bond of good behavior.

The court directed the 59-year-old actor to pay Rs 1.5 lakh as compensation to assault victim Pratik Pashine for availing the benefit of release under the Probation of Offenders Act.

About 2005 assault case

In November 2016, the Metropolitan Magistrate (Andheri) had convicted Pancholi under IPC Section 325 (voluntarily causing grievous hurt) and sentenced him to one year of simple imprisonment for attacking Pashine over a parking dispute in 2005. Pancholi later appealed against the ruling. On Thursday, February 20, Additional Sessions Judge D.G. Dhoble partially allowed his appeal, modifying the sentence so that he would not have to serve time in jail.

The altercation occurred in August 2005 when Pancholi got into a dispute with his neighbor over a parking issue. That evening, upon finding a car parked in his designated spot, he parked his own car behind it. Around 8 p.m., Pashine’s watchman called him and asked him to move his vehicle. After a brief argument over the intercom, Pashine agreed and went downstairs to shift his car.

As he attempted to leave, Pancholi confronted him and allegedly attacked him. When Pashine’s father tried to intervene, he too was assaulted. The following day, Pashine filed a complaint at Versova police station.

Pancholi was booked under IPC sections 323 (voluntarily causing hurt), 325 (voluntarily causing grievous hurt), 504 (intentional insult with intent to provoke a breach of peace), and 501(2) (defamation).
